The Reform of the Law of Obligations has changed the Law governing the sale of horses drastically. It also effects the vet inspection of horses. The first part of the article, published in issue 2/2003, explained the background of the reform and the main new elements of the law. The second part of the article focuses on the law governing the sale of goods and constructions. This law has also been reformed in 2002. It serves as legal basis of the vet inspection. Legally the vet inspection is an expertise of the physical condition of the horse. The law governing the sale of goods and construction also includes a new definition of fault (Mangel) similar to the definition of fault in the Law governing the sale of horses. In the case of the occurrence of a fault the vet is liable for damages of the purchaser and seller. Private standards like the Rontgenleitfaden or protocols for vet inspections become more important. The limitation period for the rights of the mandator of the vet was reduces from 30 to a maximum length of 13 years. An exclusion of liability or the introduction of clauses stating a maximum amount of liability will often be invalid. In the future the medical documentation and the information of purchaser and seller will reach main importance.
