Abstract

Objective: Exploration of criminological and clinical factors predicting court orders after conditional release from forensic psychiatric institutions in Bavaria. Methods: Data from nearly all patients (n = 2313) released from Bavarian forensic hospitals between 2010 and 2017 were evaluated. Results: Decisive factors predicting the application of court orders were diagnostic attributions and offence characteristics. Court orders concerning residential aftercare in specialized institutions were primarily applied to mentally ill patients with addictive or affective disorders and sexual or traffic offences. Moreover, they were applied to addicted patients with violent offences. Court orders regarding the abstinence of alcohol and drugs were mainly assigned to patients with drug abuse and violent and fraud offences. Furthermore, the use of specific court orders differed significantly between the seven administrative districts of Bavaria.
