Abstract

So far, there are only few and undifferentiated findings on how substance use during and after forensic psychiatric addiction treatment according to Sect. 64 of the German Criminal Code is related to legal probation after release. In particular, the role of abstinence- oriented treatment has never been critically challenged in this context. The question of the present evaluation revolves around the topic of abstinence orientation or prerequisite for regular therapy release and legal probation, around the offence occurrence in the case of redelinquency and around secondary or tertiary preventive influence possibilities. Consumption patterns during treatment are assessed using Bavarian datasets from the Institute for Quality Management's (IfQM) Outcomes Quality Survey (N = 4,201). These are based on third-party and self-reported data, file entries, questionnaires and interviews. For the 1- year follow- up, information is available on 2,391 inmates with regular termination of the treatment order resulting in a release on parole, supplemented by catamnestic data from so-called drop-out patients of one Bavarian administrative district (n = 340: 1-year follow-up after release from prison). The explorative evaluations of drug related and legal behavior of former patients according to Sect. 64 of the German Criminal Code provide evidence that neither moderate nor reduced consumption is per se unfavorable concerning the legal prognosis. The results encourage a critical look at the concept of abstinence as the sole therapeutic goal and a therapeutic approach oriented to the needs and abilities of the patients.
