Abstract

Abstinence is currently the predominant treatment goal of forensic psychiatric addiction treatment. However, the purpose of any forensic psychiatric intervention under criminal law is only to ensure that after treatment no further crimes are committed as a result of the psychiatric problem. It remains undefined how this is to be achieved. With regard to Section 64 of the German Criminal Code, the misleading concept of healing a >> tendency << to consume addictive substances in excess is not to be equated with abstinence. Nor can a substance use disorder be overcome only by complete abstinence. Rather, alternatives to the abstinence orientation also and especially in the forensic context, allow for suitable options to those patients who are not willing or able to achieve abstinence. This article examines the goal of abstinence from a legal point of view and takes a critical look at >> healing << an addiction illness. A case example illustrates the problems that can arise from narrowing the focus on abstinence as the sole goal of forensic addiction treatment. As a conclusion, it seems appropriate that the implicit and exclusive abstinence orientation gives way to a more goal-open approach.
